Terms Of Service

Consent

Use of the services of Nocturnal Tours (herein referred to as Tour Operator) is subject to acceptance of our terms and conditions. By accessing our website or booking a tour, you agree to be bound by these terms of use. Please read our terms and conditions carefully before using this website or engaging our services.

Bookings

Receipt of payment and completion of the booking form does not imply or guarantee a tour reservation. No contact exists until the Tour Operator issues a written confirmation notice. We cannot assure the availability of any of our services at any given time.

By making a booking, you affirm that you are at least 21 years of age. You must provide the Tour Operator with complete and accurate information. Upon receipt of your confirmation, check the details and immediately contact us to report any discrepancies.

When booking a tour on behalf of others, you become the designated representative of the guests in your party. As such, you are responsible for providing complete and accurate information regarding each participant, obtaining the required consents, keeping your party informed and notifying the Tour Operator if a change or cancellation is required.

On no occasion will the Tour Operator be held liable for errors or omissions in the information provided for a booking. We reserve the right to refuse a booking without giving a reason; in the event we are unable to accept your booking, we will contact you and return any payment received.

Pricing

Pricing is published at a per-person rate, and the price quoted for a tour only covers the cost of services provided by the Tour Operator. You are responsible for any additional expenses incurred, which may include food and drink, entertainment and transportation to the tour’s start point or from the final tour destination.

Published, advertised and quoted prices are subject to change due to fluctuations in exchange rates, fuel surcharges and other factors beyond the Tour Operator’s control. However, the price of a tour will not increase after you have paid in full.

Occasionally, the Tour Operator may offer reduced pricing or special rates for certain services. This applies only to new bookings; after payment has been sent for a tour, the booking is not entitled to any form of price reduction.

The Tour Operator reserves the right to correct errors in quoted prices before a tour booking is confirmed. Should we become aware of an error, we will advise you of the applicable price at the time of your booking.

Payment

Payment for services rendered by the Tour Operator may be made by most major credit cards, including Visa, Mastercard, Discover and American Express. To book a tour, complete payment must be submitted with the booking form.

Once payment has been made and confirmation has been sent by the Tour Operator, your right to change or cancel the booking is limited. We may allow you to change the date of your tour if you contact us before the event starts, and we impose fees for rescheduling a tour. However, the new tour date must be within a year of the originally scheduled tour.

Cancellations are subject to penalties. For a tour canceled more than 24 hours prior to departure, the Tour Operator may offer a partial refund. Otherwise, no refunds will be issued and cancellation fees total the full value of our services. In the event of a cancellation within the 24-hour period before the start of a tour, the full ticket price will be charged to the credit card used for the booking. Any fees once paid will not be refunded under any circumstances.

In no case will the Tour Operator assume responsibility for any costs incurred as a result of rescheduling or canceling a tour. We will not be held liable for local transportation, lodging or meals; nor will we be held responsible for travel costs, visa fees or any other incidental expenses or consequential losses relating to a rescheduled or canceled booking.

Documentation

All tour guests, without exception, must carry valid documentation at all times. It is your responsibility to ensure that you have a valid form of identification in your possession; acceptable documents include USA government-issued driver’s licenses, state identification cards and passports. Military identification cards, expired documents and photocopies are not considered valid for tour participation.

The Tour Operator assumes no liability if you or a member of your party is unable to proceed with a tour due to a missing or invalid form of identification. Should that occur, we will not issue a refund or offer any other compensation for the termination of our services.

Responsibilities

By making a booking, you acknowledge that the services we offer may come with potential risks to your personal safety. You hereby assume these risks, releasing the Tour Operator from any responsibility for losses, damages, injuries or death resulting from the risks that are inherent in adventurous activities.

While traveling with the Tour Operator and during the time spent at all tour destinations, you must comply with all applicable laws and regulations. Should you fail to do so, or should you commit an illegal act, we may refuse to provide services. Any arrangements you must make due to being expelled from a tour will be at your expense and without any liability on the part of the Tour Operator. In such an event, you will not be entitled to a refund.

Any property damage or destruction caused by you while on a tour comes at your expense. The Tour Operator is not liable for the costs of repair, replacement or cleaning services. This includes, but is not limited to, expenses incurred for any physical damage or contamination to the interior or exterior of any vehicle used during the course of the tour. In the event you or a guest in your party gets sick and soils the vehicle, a cleaning fee of $500 will be charged to the credit card used for the booking. If you fail to make full restitution to the appropriate party, you will be responsible for meeting any claims and paying any legal costs the Tour Operator incurs as a result of your actions.

Dress Code 

Proper attire is required at all times. All bookings are issued subject to the dress code policies of the tour destinations, and the venues we do business with have strict regulations. 

All tour guests are expected to wear clean, neatly ironed clothing that fits well and is appropriate for the upscale environment. It is your responsibility to be suitably dressed as per the venue guidelines. The Tour Operator is not obligated to provide the full dress code policies of the tour destinations or to keep guests apprised of any changes to those policies. However, we provide basic information as a courtesy.

Gentlemen: The standard for males who book a daytime tour is swim trunks or board shorts with a fitted polo or Hawaiian shirt and pool shoes or upscale flip-flops. For nighttime tours, males are expected to wear fitted designer jeans or dark slacks with a nice collared shirt or sport coat.

Ladies: For females who book a daytime tour, the standard is a flattering bikini or one-piece swimsuit with a lightweight wrap or cover-up, wedges, heels or pool shoes. In regards to nighttime tours, females can wear a cocktail dress or dark fitted jeans with a nice top and high heels, pumps or flats with backstrap.

Garments that are ripped, distressed, offensive, excessively baggy or see-through are not acceptable for daytime or nighttime tours, and guests are not permitted to wear hats, roughly made t-shirts or athletic apparel at any tour destination. The doorman at each venue has the right to deny entry to tour guests who are not dressed appropriately. 

If you are denied entry because of your attire, you will be allowed the opportunity to change your outfit, but any travel expenses you incur when doing so will be at your expense. No refunds will be issued due to refusal of entry for non-compliance with the dress code at any tour destination.

Force Majeure

Unpredictable circumstances may, on occasion, compel the Tour Operator to alter a portion of a tour. Should a change become necessary due to an unforeseen event or situation that is outside of our control, we reserve the right to make the change without providing advance notice. In the event of a mechanical breakdown, the Tour Operator only assumes responsibility for the tour time lost in dealing with the issue; this time will be made up on a date chosen by mutual agreement between the parties involved.

Under no circumstances will the Tour Operator be held liable for a failure or delay in the provision of services when such circumstances arise from or are caused by forces beyond control. Nor will the Tour Operator assume responsibility for any failure, delay or alteration in the provision of services due to circumstances that a tour partner, supplier or agent could not foresee or control. Should a force majeure event occur, the Tour Operator reserves the right to suspend implementation of services without providing a refund and without assuming responsibility for damages tour guests incur.

For the purposes of this agreement, an event of force majeure includes any situation or occurrence that cannot be prevented, avoided or resolved by the Tour Operator, despite the exercise of due diligence. Such events include, but are not limited to, natural catastrophes, extreme weather events, riots, labor disputes, insurrections and acts of terrorists.

The outbreak of serious disease and the presence of significant risks to human health also constitute an event of force majeure. Whether or not foreseeable, under any circumstances that make it dangerous for a tour to commence or continue, the Tour Operator is relieved from any obligation to provide services.

Marketing

During a tour, photos and videos may be taken by other tour guests and by the Tour Operator. By making a booking, you consent to such images being taken, and you agree that you may be included or featured in these images.

Your consent to the taking of photos and videos indicates that you grant the Tour Operator a perpetual, royalty-free license to use and reproduce such images for any purpose, including marketing and the creation of promotional materials. The Tour Operator may make use of photos and videos that contain or feature you in any medium, including social media and print advertising, without any obligation to provide you with any compensation.
